Breech presentations are easily detectable through modern imaging tools – the first and most crucial step in handling such complications. Doctors must properly diagnose, manage, and plan for a delivery that ensures the safety of both mother and child. Failure to do so may constitute medical malpractice.
Families suffering from their doctor’s negligence are entitled to compensation through medical malpractice claims.

What is a Breech Presentation?
Whereas normal presentations have babies’ heads facing the birth canal, breech presentations have babies showing their bottom first. There are different types of breech presentation:[1]
- Complete breech – bottom first; knees bent
- Frank breech – legs stretched up; feet near the head
- Footling breech – one leg lowered over the mother’s cervix
Breech presentations can occur in 3% to 4% of all deliveries – with incidence dropping significantly in more advanced gestational ages. Prior to the 28th week of gestation, incidence can be as high as 25%; goes down to 15% at the 32nd week; and down to 4% at full term.[2]
Associated Risk Factors
A mother’s health is crucial to the overall safety of the pregnancy and the delivery. As such doctors must provide more care and attention to relatively at-risk mothers/pregnancies. Pregnancies are more susceptible to breech deliveries when mothers:[1][2]
- Go to early labor (prematurity);
- Have multiple fetuses;
- Have uterine malformations;
- Have fibroids;
- Have excessive amniotic fluid.
During routine visits, doctors must catch these complications and manage them effectively. Failure to do so puts both mother and child at risk for long-term impairments.
Breech Presentation and Medical Negligence
Through current imaging technologies, doctors can 100% confirm if a pregnancy has a breech presentation. [3] In such cases, the key concerns are getting the baby head-down for labor; how it will be delivered; and preventing complications. Timely cesarean sections may also be taken to avoid injuries.[4]
In cases of breech presentations, here are some medical negligences that can result in adverse outcomes (all of which are valid grounds for a claim):
- Failure to diagnose breech position
- Inadequate patient counseling
- Improper use of prescribed delivery technique
- Delays in emergency C-sections
- Technical errors during breech delivery
- Inadequate fetal monitoring
- Untrained/inadequate medical team
All medical expenses (past and future) are considered in a medical malpractice claim. In birth injury cases, compensation ensures that an injured child is provided with all the necessary support for their growth and development. Injured mothers must also be allowed to return to their healthiest state.
