A parking attendant was struck by a vehicle in a hit-and-run incident before the Buffalo Bills game on Sunday night in Orchard Park, New York. According to the Erie County Sheriff's Office, the attendant was allegedly struck by the vehicle's mirror while working on Stadium Drive.
The injured attendant was transported to Mercy Ambulatory Care Center to be evaluated for back and leg pain. The vehicle allegedly did not stop after the collision, making this a hit-and-run incident. The Erie County Sheriff's Office's Crash Investigation Unit is continuing to investigate the incident and is asking anyone with information to call 716-858-2903. Common Causes of Hit-and-Run Accidents
Hit-and-run accidents can occur for various reasons, and understanding these causes can help prevent future incidents:
- Distracted driving - Drivers using cell phones, adjusting GPS, or engaging in other distractions may not see pedestrians or workers
- Impaired driving - Drivers under the influence of alcohol or drugs may have reduced reaction times and poor judgment
- Speeding or reckless driving - Excessive speed reduces a driver's ability to stop or avoid collisions
- Poor visibility conditions - Evening games, inadequate lighting, or weather conditions can make it difficult to see pedestrians
- Inexperienced drivers - Drivers unfamiliar with busy parking areas or event traffic may panic after an accident
- Fear of consequences - Some drivers flee the scene to avoid potential legal, financial, or insurance consequences
- Inadequate traffic control - Poor signage, lack of crossing guards, or insufficient barriers in high-traffic areas
- Vehicle maintenance issues - Faulty mirrors, lights, or brakes that could contribute to accidents
When negligence on behalf of a driver, property owner, or event organizer contributes to these accidents, injured victims may be entitled to legal compensation for their injuries and losses.
Personal Injury Claims in Western New York Hit-and-Run Cases
Hit-and-run accidents involving pedestrians and workers can result in serious personal injury claims, particularly in Western New York where large sporting events create heavy traffic and crowded conditions. These cases often involve complex legal issues, especially when the at-fault driver flees the scene and must be identified through investigation.
Several parties may potentially be held liable in these situations, including the hit-and-run driver (once identified), event organizers who may have failed to provide adequate safety measures, property owners responsible for parking lot safety, security companies hired to manage traffic flow, or even the venue itself if inadequate lighting or signage contributed to the accident. Victims may be entitled to compensation for medical expenses, lost wages, pain and suffering, future medical care, and in cases of wrongful death, funeral expenses and loss of companionship. However, each case is unique and results cannot be guaranteed.
Damages and Compensation in Hit-and-Run Cases
Understanding the types of damages available in hit-and-run cases is crucial for victims and their families. Compensation typically falls into several categories designed to address both immediate and long-term impacts of the injury.
Economic damages cover tangible financial losses such as medical bills, emergency room visits, ongoing treatment costs, lost wages from missed work, and reduced earning capacity if the injury affects future employment.
Non-economic damages address the intangible impacts like pain and suffering, emotional distress, loss of enjoyment of life, and permanent disability or disfigurement.
Future damages may include ongoing medical care, rehabilitation costs, and long-term care needs. In cases involving gross negligence or intentional conduct, punitive damages may also be available to punish the wrongdoer and deter similar behavior.
Compensation is calculated based on medical records, employment history, expert testimony, and evidence of how the injury has impacted the victim's life. The purpose is not only to restore the victim financially but also to hold negligent parties accountable and prevent similar incidents.
