A correctional officer at Wende Correctional Facility in Alden, New York was rushed to Erie County Medical Center after being exposed to fentanyl while on duty. According to the New York State Correctional Officers & Police Benevolent Association (NYSCOPBA), the 55-year-old officer was opening cells for inmate recreation when she suddenly became dizzy and nauseous, prompting fellow officers to call for immediate medical assistance.
The incident raises serious concerns about workplace safety protocols at correctional facilities. NYSCOPBA Western Region Vice President Kenny Gold expressed alarm that it took two hours to transfer the officer from the facility's emergency room to the hospital after she developed symptoms. At Erie County Medical Center, the officer tested positive for fentanyl and was admitted overnight for observation before being released the next day. She has not returned to work since the incident. Common Causes of Workplace Fentanyl Exposure
Workplace fentanyl exposure in correctional facilities and other environments can occur through various means:
- Airborne particles during searches or handling of contaminated materials
- Direct skin contact with surfaces or items containing fentanyl residue
- Inadequate personal protective equipment or improper safety protocols
- Insufficient ventilation systems that allow dangerous substances to accumulate
- Lack of proper training on hazardous substance identification and response
- Delayed emergency response protocols that increase exposure time
- Contaminated mail or packages containing illegal substances
- Poor facility maintenance allowing substances to spread through ventilation or surfaces
When employers fail to provide adequate safety measures, proper training, or appropriate emergency response protocols, their negligence may entitle victims to legal compensation for injuries sustained in the workplace.
Personal Injury and Workers' Compensation Claims in Western New York
Correctional officers and other public employees who suffer injuries due to workplace fentanyl exposure may be entitled to both workers' compensation benefits and potential personal injury claims. In New York State, workers' compensation typically covers medical expenses, lost wages, and disability benefits for employees injured on the job, regardless of fault.
However, additional legal action may be possible against third parties whose negligence contributed to the exposure. Potentially liable parties could include contractors responsible for facility maintenance, vendors who failed to properly screen incoming materials, or manufacturers of defective safety equipment. Compensation in these cases may include medical expenses, lost wages, pain and suffering, and future medical care costs. Each case requires careful evaluation to determine all available legal remedies and ensure victims receive the full compensation they deserve.
Damages and Compensation
Victims of workplace fentanyl exposure may be entitled to several types of compensation:
Economic Damages include all measurable financial losses such as current and future medical bills, prescription costs, lost wages during recovery, and reduced earning capacity if the exposure causes long-term health effects.
Non-Economic Damages cover pain, suffering, emotional distress, and loss of life enjoyment. For example, an officer who develops chronic respiratory issues or anxiety about returning to work may receive compensation for these impacts on their quality of life.
Future Losses are calculated based on medical expert testimony about ongoing treatment needs, potential career limitations, and long-term health monitoring requirements. Evidence such as medical records, employment history, and expert witness testimony helps establish the full extent of damages.
The purpose of compensation extends beyond just covering expenses—it holds negligent parties accountable for safety failures and serves as a deterrent to prevent similar incidents. Our experienced legal team at Porter Law Group works with medical experts and vocational specialists to ensure all current and future damages are properly calculated and pursued.
