An Oneida County driver died in a fiery crash on November 22, 2024, along Route 49 in the town of Floyd, Syracuse, New York.
A Sheriff's Office deputy reported that around 10:30 PM, he witnessed a 2022 Ford Explorer heading west in the eastbound lane. The SUV almost hit the police vehicle and another vehicle in front of it. The deputy deployed his lights and siren in an attempt to stop the SUV. Still, it kept going, eventually hitting a Volvo truck and causing both vehicles to catch on fire.
The Volvo truck driver, now identified as Franklyn Hummel, 64, was able to escape unharmed. But the deputy was unable to extract the SUV driver, who died at the scene, from his burning vehicle. His identity is being determined by the Onondaga County Medical Examiner’s Office.

Personal Injury Protection in New York
New York is a no-fault insurance State. All drivers are required to carry a minimum amount of personal injury protection insurance. In the event of a vehicular accident, such as a car fire from a crash, you will have to recover compensation from your insurance provider. However, if you have sustained ‘serious injury’, you may also be allowed to pursue additional compensation from the at-fault driver.
New York’s insurance law qualifies the following as serious injury:
- Death;
- Dismemberment;
- Significant disfigurement;
- A fracture;
- Loss of a fetus;
- Permanent loss of use of a body organ, member, function, or system;
- Permanent consequential limitation of use of a body organ or member;
- Significant limitation of use of a body function or system; or
- An injury/impairment that hinders a person from usual daily activities for at least 90 days (within the first 180 days following the accident).
What Damages Can You Receive Compensation For?
Our experienced team of personal injury attorneys is versed in the legal complexities of car accident litigation and can help you recover compensation for:
- Medical expenses
- Pain and suffering
- Loss of income and earning capacity
- Diminished quality of life
- Disability and disfigurement
- Wrongful death
There may also be avenues for third-party lawsuits. If your car fire accident was caused by faulty vehicle parts or a manufacturing error, you may have a product liability claim against the car manufacturer. Or if the accident was caused by unmaintained roads or unsafe construction, you may be able to pursue the agency responsible, or the negligent contractor. These cases will add more complexity to your claims, so it is important to seek help from experienced personal injury lawyers so that you can be assured that you are receiving the best compensation possible and not walking away with less than you deserve.
