T-bone Accidents in New York

T-bone accidents, also known as side-impact collisions, occur when one vehicle strikes another at a perpendicular angle, forming a "T" shape. These accidents are particularly dangerous because the sides of vehicles typically have less protective structure compared to the front and rear, making occupants more vulnerable to severe injuries.

In New York State, T-bone collisions account for approximately 25% of all serious vehicle accidents, with a significant portion occurring at intersections. According to recent data from the New York State Department of Motor Vehicles, these accidents resulted in over 300 fatalities and thousands of serious injuries in the past year alone. The survival rate for T-bone accidents varies significantly based on factors such as vehicle speed, point of impact, and vehicle safety features.

Common injuries from T-bone accidents include:

The risk of fatality is particularly high when a larger vehicle, such as a tractor-trailer, impacts a smaller passenger vehicle, with survival rates dropping significantly in such scenarios.

Recovering Compensation for a Car Accident in New York

While in the current case, the driver appears to be at fault for failing to yield at the stop sign, New York's pure comparative negligence system means that injured parties may still be able to recover damages, even if they bear some responsibility for the accident. However, the percentage of fault will reduce the amount of compensation proportionally. Given the complexity of such cases, consulting with an experienced personal injury lawyer is crucial to understand all available legal options.

New York operates under a "No-Fault" insurance system, requiring all drivers to carry Personal Injury Protection (PIP) insurance with minimum coverage of $50,000. This coverage pays for medical expenses, lost wages, and other basic economic losses regardless of who caused the accident. However, to pursue a claim directly against the at-fault driver, the injury must meet New York's "serious injury" threshold, which includes:

  • Death
  • Dismemberment
  • Significant disfigurement
  • Fracture
  • Loss of a fetus
  • Permanent loss of use of a body organ, member, function, or system
  • Permanent consequential limitation of use of a body organ or member
  • Significant limitation of use of a body function or system
  • Medically determined injury preventing usual activities for 90 days within the 180 days following the accident
