$2.6 Million Recovery For Child That Suffered Permanent Disability Due to Medical Malpractice

A single mother called our office with questions about her son’s recently diagnosed permanent disabilities. He had appeared to be relatively healthy at the start of his life but had soon been diagnosed with relatively profound disabilities. One of her son’s new doctors suggested that another physician’s medical error may have caused the injuries, so she came to us for answers. After obtaining her son’s medical records, we were able to secure the necessary expert support, which concluded that, in fact, the boy’s disabilities would absolutely have been prevented with competent medical care. His mother was devastated to hear the news, and she couldn’t believe that her son’s life would never be the same because a doctor she had trusted failed to do her job.

The negligent doctor fought the case for more than a year. The lawyers hired by the insurance company put our client through the paces, and the doctor claimed innocence at every turn of the litigation. However, we stayed the course, and aggressively pursued the claim with the assistance of one of the country’s foremost medical experts.

Ultimately, after professing her blamelessness for years, the doctor’s insurance company told us that she wanted to settle the case. At first, the insurance company was not willing to pay our client what she thought was fair, and the case did not settle right away. After more litigation, the insurance company contacted us again and significantly increased its settlement offer. They agreed to pay an amount that will provide the child and his mother with financial security for the rest of their lives.

We developed an incredibly special relationship with our client and her son. We remain in contact even now, after their case has been resolved. We will be forever proud of the recovery we were able to obtain for them and for our ability to hold the responsible doctor accountable for the damage she caused.
