In New York, injured cyclists can sue the at-fault driver directly for pain and suffering without meeting any injury threshold, because bicycles are excluded from the no-fault insurance system under Insurance Law Section 5103. Bicycle accident settlements in New York typically range from $50,000 for moderate injuries with a full recovery to $1 million or more when the crash causes a traumatic brain injury, spinal damage, or permanent disability. A bicycle accident can leave you with serious injuries, a damaged bike, medical bills, and time away from work, all at once. At the same time, the driver's insurance company will likely start building a case against you almost immediately, often portraying the cyclist as the one at fault. Bias against cyclists in claims is well documented, and without someone handling your case, it is easy to end up settling for far less than your injuries are worth.
A New York bicycle accident attorney can investigate the crash, gather the evidence needed to establish the other party's fault, and deal with the insurance company on your behalf. That means securing the police report, obtaining surveillance or traffic camera footage before it is overwritten, interviewing witnesses, and consulting with accident reconstruction experts when the facts are disputed.
Bicycle accident cases in New York also involve specific insurance and liability rules that are different from car accident cases. Having an attorney who understands how those rules apply to cyclists specifically can make a real difference in what you recover.
Porter Law Group works on a contingency-fee basis. You pay nothing unless we recover compensation for you.

Most bicycle accidents in New York involve a collision with a motor vehicle. According to the National Highway Traffic Safety Administration, 1,105 cyclists were killed in traffic crashes across the United States in a single recent year, and many thousands more were seriously injured. The most common causes in New York include:
This is one of the most important things to understand about bicycle accident claims in New York, and most cyclists are not aware of it until they have already been hurt.
New York is a no-fault state, which means that after a car accident, drivers and passengers typically file with their own insurance for medical bills and lost wages regardless of who caused the crash. Car accident victims can only sue for pain and suffering if their injury meets a specific legal threshold.
Cyclists are treated differently. Bicycles are excluded from New York's no-fault system under Insurance Law Section 5103. That means you are not automatically covered by your own no-fault benefits after a bicycle crash, but it also means you are not bound by the serious injury threshold when you want to sue. A cyclist who is hurt in a collision with a car can file a personal injury claim against the at-fault driver for any level of injury, without having to prove that the injury meets a severity cutoff.
In practice, this means that even injuries that a court might consider moderate can support a lawsuit for a cyclist in New York where the same injury might not clear the threshold for a car occupant. The key is proving the driver was at fault and that the crash caused your injuries.
One important note: if you or a household family member owns a car with PIP coverage, you may be able to access those no-fault medical benefits even as a cyclist, depending on the specific policy and circumstances. An attorney can review whether that coverage applies to your situation.
Because a cyclist has no protection beyond a helmet and clothing, the injuries from a collision with a vehicle tend to be significantly more severe than those suffered by car occupants in the same crash.
Traumatic brain injury is a serious risk even when a cyclist is wearing a helmet. The rotational forces from being thrown from a bike can cause concussions and more severe brain injuries that affect memory, concentration, mood, and the ability to work and carry out daily life.
Spinal cord and neck injuries result from the sudden force of impact or from landing on the ground or a hard surface. These injuries range from herniated discs requiring surgery to complete spinal cord injuries resulting in permanent paralysis.
Fractured bones are common in bicycle crashes. Collarbone fractures, wrist fractures from reaching out to break a fall, leg and hip fractures from direct impact, and rib fractures from being thrown onto pavement all frequently require surgery and extended recovery.
Road rash refers to the skin abrasions a cyclist sustains when sliding across pavement after a crash. Severe road rash can damage not just skin but underlying muscle and tissue, may require skin grafts, and can leave permanent scarring.
Internal injuries to organs including the spleen, liver, and kidneys can occur from high-speed impact and may not be obvious at the scene. Seeking a full medical evaluation immediately after a crash can catch injuries that are not yet producing noticeable symptoms.
When a bicycle accident claim is successful, compensation falls into two main categories.
Economic damages cover the direct financial losses caused by the crash. These include past and future medical bills, the cost of surgery and rehabilitation, lost wages from time missed at work, loss of future earning capacity if the injury prevents you from returning to the same work, and the cost of replacing or repairing your bicycle and equipment.
Non-economic damages cover the impact the injuries have had on your life beyond the financial costs. Pain and suffering, emotional distress, the loss of activities you could do before the crash, and the effect on your family relationships are all recognized forms of harm in New York. There is no cap on non-economic damages in personal injury cases in New York.
Punitive damages are rare but may be available when a driver's conduct was especially reckless, such as driving drunk, fleeing the scene, or deliberately aggressive driving.
The value of a bicycle accident case depends on the severity of your injuries, the clarity of the other party's fault, the insurance coverage available, and the long-term impact on your ability to work and live your life. The table below reflects typical outcome ranges in New York bicycle accident cases.
| Case Profile | Typical Settlement Range |
| Minor injuries, soft tissue, full recovery | $15,000 to $50,000 |
| Moderate injuries, fractures or surgery required | $50,000 to $250,000 |
| Serious injuries, TBI or spinal damage, extended recovery | $250,000 to $750,000 |
| Permanent disability or significant long-term impairment | $750,000 to $2,000,000 or more |
| Wrongful death from a bicycle accident | $500,000 to $5,000,000 or more |
Because cyclists can sue without meeting a serious injury threshold, even moderate injuries can support a meaningful personal injury claim in New York. The strength of liability evidence, particularly whether the driver clearly violated a traffic law, is often one of the biggest factors in case value. We’ll explain your rights and what compensation you may be entitled to pursue after a bicycle accident.
Most bicycle accident personal injury claims in New York must be filed within three years of the date of the crash. Wrongful death claims must be filed within two years of the date of death.
If your crash involved a government vehicle, a city-maintained road defect, or a municipality in any way, a Notice of Claim must be filed within 90 days of the accident. Missing that window typically ends any claim against that entity permanently, regardless of how strong the underlying case is.
If the driver who hit you was uninsured or fled the scene, there are separate deadlines for uninsured motorist claims and Motor Vehicle Accident Indemnification Corporation claims that can be even shorter. Speaking with an attorney quickly after the crash is the safest way to make sure none of these deadlines are missed.

Yes. New York does not have a law requiring adult cyclists to wear helmets, so the absence of a helmet does not bar your claim. However, if your head injuries are part of the claim and you were not wearing a helmet, the other side may argue that you share some fault for the severity of those injuries under New York's comparative fault rule. Your compensation would be reduced by your percentage of fault, not eliminated. An attorney can address this argument using evidence about the nature of the crash and the injuries involved.
A municipality or government agency responsible for road maintenance may be liable if a pothole, defective grate, or poor road condition caused or contributed to your crash. These claims have their own rules, including a requirement that the government had prior written notice of the specific defect in many cases. They also require a Notice of Claim to be filed within 90 days. Road defect claims can run alongside a claim against a driver if both contributed to the accident.
You may still be able to recover compensation. If the driver cannot be identified, the Motor Vehicle Accident Indemnification Corporation can cover certain losses for hit-and-run bicycle accidents under specific conditions. If the driver is identified but uninsured, your own uninsured motorist coverage may apply if you or a family member in your household owns a vehicle with that coverage. An attorney can identify all available sources of compensation in your specific situation.
Porter Law Group handles bicycle accident cases on a contingency-fee basis. You pay nothing upfront and nothing during the case. Our fee is a percentage of the recovery at the end, collected only if we win. If we do not recover compensation for you, you owe nothing.
Yes. New York follows a pure comparative fault rule, which means your compensation is reduced by your share of fault but not eliminated. If you were found 20 percent at fault in a case valued at $300,000, you would still recover $240,000. Insurance companies often attempt to place more fault on the cyclist than the evidence supports. An attorney can counter those arguments with the police report, traffic camera footage, and witness accounts.
