Rear-End Truck Accident Lawyer in New York

If a commercial truck hit you from behind, or if you rear-ended a truck and your car went underneath it, you are dealing with something far more serious than a typical fender-bender. Rear-end truck accidents in New York cause some of the most devastating injuries seen on the road, and settlements typically range from $75,000 for moderate injuries to well over $3 million for catastrophic cases. Because trucks can weigh up to 80,000 pounds when fully loaded, the damage they cause to a passenger vehicle is on a completely different level. New York law generally places fault on the driver who hits from behind, but insurance companies will fight hard to blame you instead. Porter Law Group has recovered more than $500 million for seriously injured clients, and the firm knows exactly how to counter those tactics.

Why Choose Porter Law Group for Rear-End Truck Accident Cases?

Handling a rear-end truck accident case is not the same as handling a car accident. The truck driver's employer, the company's insurance team, and their defense attorneys move fast, and they have a lot of experience minimizing what they pay out. Porter Law Group matches that from day one. With published jury verdicts showing results 20 to 34 times higher than what the insurance company originally offered, the firm has a track record of refusing to settle for less than a case is worth. Led by Harvard-educated attorney Michael S. Porter, a former U.S. Army JAG Corps Captain with over 20 years of trial experience, the firm brings in accident reconstruction engineers who analyze the truck's data recorder, braking records, and following-distance calculations to prove exactly why the truck driver failed to stop in time. Seven of eight attorneys have been recognized by Super Lawyers, a distinction earned by fewer than 5% of New York attorneys.

"Insurance companies love to say the lead driver stopped short. That is almost never a valid defense when a commercial truck rear-ends a passenger car. The truck driver has a legal duty to maintain a safe following distance at all times, and a 40-ton truck that cannot stop in time is a truck that was following too close, going too fast, or both." How Do Rear-End Truck Accidents Happen in New York?

Rear-end truck collisions follow two primary patterns. The first, and more dangerous, is when a truck slams into the back of a smaller vehicle. The car absorbs the full force of an 80,000-pound impact. The second is when a car strikes the rear of a truck or trailer, which creates the risk of an underride crash where the vehicle slides beneath the trailer with deadly results.

Following too closely (tailgating) is the most frequent cause. A fully loaded commercial truck at highway speed needs roughly 525 feet to come to a complete stop, nearly twice the distance of a passenger car. If the truck is only 200 feet behind the car ahead of it, there is simply not enough room to stop before impact, no matter how fast the driver reacts.

Driver fatigue is another major factor. According to the Federal Motor Carrier Safety Administration (FMCSA), fatigue contributes to approximately 13% of large truck crashes. A tired driver reacts more slowly, which adds dozens of additional feet of stopping distance and turns a close call into a serious collision. Federal rules limit how many hours a driver can be behind the wheel before they must rest, and violations of those rules are common.

Distracted driving is an increasing problem among commercial truck operators. Cell phones, GPS devices, and dispatching screens pull a driver's eyes off the road for several seconds at a time. At highway speeds, a few seconds of distraction means the truck travels hundreds of feet with no input from the driver.

Brake failure and poor maintenance turn a manageable situation into a disaster. Brake problems are the most frequently cited vehicle-related factor in large truck crashes. Trucking companies are required by federal rules to inspect and maintain their braking systems regularly. When they skip those inspections or ignore known problems, they can be held directly responsible for what happens.

How Does a Rear-End Truck Collision Differ From a Car-on-Car Crash?

The injuries and legal complexity of a rear-end truck accident are on a completely different level from a standard car accident. The table below shows the key differences.

Who Is at Fault in a Rear-End Truck Accident in New York?

The truck driver bears the strongest presumption of fault. In New York, a driver who strikes another vehicle from behind is generally considered to have been following too closely or not paying attention. The burden falls on the truck driver to explain why the collision was not their fault, which is very difficult to do.

The trucking company is often liable too. Companies that employ truck drivers can be held responsible for their drivers' actions while on the job. They can also be held independently responsible if the crash happened because of violations of federal safety rules, inadequate driver training, or pressure from management to meet an impossible delivery schedule.

Brake and parts manufacturers may share liability. When brake failure or a defective part caused or contributed to the crash, the manufacturer of that component can be held accountable under product liability law. The truck's onboard data recorder captures braking information just before impact and can show whether the brakes worked at all.

The driver in front rarely shares significant fault. Insurance companies routinely argue that the lead driver stopped suddenly or was traveling too slowly. Under New York law, a driver is entitled to stop at any time, and the driver behind is responsible for maintaining enough distance to stop safely. Partial fault on the lead driver is rare and usually accounts for only a small portion of the overall responsibility.

What Compensation Can You Recover After a Rear-End Truck Accident?

Economic damages cover the real financial costs you have faced and will face in the future. These include emergency room and hospital care, surgery, physical therapy and rehabilitation, ongoing medical treatment, the wages you lost while you were unable to work, and any reduction in your long-term earning ability. Truck accident injuries are frequently severe enough to require care for years or even decades.

Non-economic damages cover the parts of your life that do not come with a price tag but matter just as much. Pain and suffering, emotional distress, inability to do the things you once enjoyed, scarring, and permanent disability all factor into this part of a claim. New York does not limit how much you can receive for these losses.

Wrongful death damages are available when a rear-end truck crash takes a life. Recoverable losses include future income the person would have earned, the guidance and companionship the family has lost, and funeral costs. These claims frequently settle in the range of $1 million to $10 million.

Punitive damages may be available in cases where the trucking company acted with reckless disregard, for example, if they knowingly sent a driver who had already exceeded the legal driving limit back out on the road, or if they repeatedly ignored documented brake problems.

How Long Do I Have to File a Rear-End Truck Accident Claim in New York?

Standard deadline: 3 years. Most rear-end truck accident claims must be filed within 3 years from the date of the accident. However, truck-specific evidence is extremely time-sensitive. The truck's data recorder can be overwritten within 30 days, and trucking companies may repair or scrap the vehicle before your attorney can inspect the braking system.

If a government entity is involved: 90 days. If a malfunctioning traffic signal or road defect contributed to the crash, a formal legal notice must be filed within 90 days, and the lawsuit must follow within 1 year and 90 days.

Wrongful death: 2 years. The family or estate has 2 years from the date of death to bring a wrongful death claim. Claims on behalf of minors are extended until they reach the age of 21.

ACT NOW BEFORE YOUR DEADLINE EXPIRES

What Should You Do After a Rear-End Truck Accident in New York?

1. Call 911 and stay at the scene. Ask the responding officer to document the truck's federal carrier number, company name, driver's license number, and the direction of impact confirming the rear-end collision.

2. Photograph the damage pattern. Damage to the back of your vehicle and the front of the truck proves the direction and force of the collision. Also photograph the truck's license plate and company identification numbers on the cab, road conditions, and any skid marks showing how far the truck traveled before stopping.

3. Check for hazardous materials and fluid leaks. Rear-end collisions can rupture a truck's fuel tank or damage cargo. If you see leaking fluids or hazmat warning signs on the trailer, move to a safe distance and tell the 911 dispatcher what you see.

4. Seek medical attention within 24 hours. Whiplash, concussions, herniated discs, and internal injuries from rear-end impacts frequently develop slowly. Getting checked out the same day creates a clear medical record linking your injuries to the crash.

5. Do not give a recorded statement or sign anything from the trucking company. Claims adjusters will try to get you to admit fault or accept a fast settlement. Direct all communication through your attorney.

6. Contact a rear-end truck accident lawyer immediately. An attorney can send a formal legal notice within 24 hours demanding that the trucking company preserve data records, brake inspection history, driver logs, and dashcam footage before they disappear. Porter Law Group offers free consultations on a contingency-fee basis, meaning you pay nothing unless we win.

Frequently Asked Questions About Rear-End Truck Accidents in New York

How much is a rear-end truck accident settlement worth in New York?

Settlements typically range from $75,000 for moderate injuries such as whiplash and herniated discs to well over $3 million for severe or permanent injuries. The value of your case depends on how seriously you were hurt, how much medical care you have needed and will need in the future, the income you have lost, and how much insurance coverage the trucking company carries. Because commercial trucks are required to carry far more insurance than a regular driver, the amount available to you is usually much higher than in a typical car accident.

Is the truck driver always at fault in a rear-end collision?

The driver who strikes from behind is generally presumed to be at fault under New York law, and this is especially true for commercial truck drivers who are held to a higher standard than regular drivers. While insurance companies may argue that the car in front stopped suddenly, New York courts consistently hold that a following driver must be prepared to stop at all times. Partial fault on the lead driver is rare and usually represents only a small portion of overall responsibility.

Can I sue the trucking company, not just the driver?

Yes. Trucking companies can be held responsible for their driver's actions while on the job. They can also be held independently responsible for failures on their part, such as not properly training the driver, ignoring known mechanical problems, or pressuring the driver to stay on the road longer than the law allows. When both the driver and the company share fault, each carries its own insurance coverage, which can significantly increase the total compensation available to you.

How long do I have to file a rear-end truck accident claim in New York?

For most cases, you have 3 years from the date of the accident. However, the clock on critical evidence starts running immediately. The truck's data recorder can be overwritten in as little as 30 days. If a government entity such as a municipality was partly responsible, a formal notice must be filed within 90 days. Wrongful death claims must be filed within 2 years. Contacting an attorney as soon as possible after the crash is the best way to protect your right to recover.

How much does a rear-end truck accident lawyer cost?

Porter Law Group works on a contingency-fee basis, which means you pay nothing unless the firm recovers compensation for you. There are no upfront costs, no retainers, and no hourly fees. The firm covers all expenses for accident reconstruction, expert witnesses, and evidence analysis from the start. If the case does not result in a recovery, you owe nothing.
