A Rochester police officer fired a single shot at an armed man who was violently assaulting another person in a backyard on Weyl Street, according to newly released body-worn camera footage. The incident occurred on August 15 when officers were investigating a stolen vehicle and witnessed two men running through the neighborhood with "shots being fired amongst them."
The officer followed the men into a backyard where he discovered a 48-year-old man pinning another person to the ground and pistol-whipping him. Despite repeated commands to show his hands, the armed individual continued his assault. After approximately 10 seconds, the officer fired one shot, striking the attacker in the stomach. Both men were transported to the University of Rochester Medical Center with non-life threatening injuries and have since been released. The shooter was charged with criminal possession of a weapon and criminal use of a firearm. The original news report can be found here.
Common Causes of Violent Assault Incidents
Violent assault incidents in neighborhoods can stem from various factors and circumstances:
- Drug-related disputes and territory conflicts
- Personal vendettas or ongoing feuds between individuals
- Domestic violence situations that escalate in public spaces
- Property crimes that turn violent, such as theft or robbery
- Gang-related activities and retaliation
- Mental health crises or substance abuse issues
- Disputes over money, relationships, or other personal matters
- Random acts of violence by individuals with criminal histories
When violent assaults occur due to the negligence or wrongful actions of property owners, security companies, or other parties who failed to maintain safe environments, victims may be entitled to legal compensation for their injuries and trauma.
Personal Injury Claims in Rochester, NY Assault Cases

In cases involving shootings, pistol-whipping, and other forms of violent assault, multiple parties could potentially be held liable for damages.
Potential liable parties in assault cases may include: negligent property owners who failed to provide adequate security, businesses that over-served alcohol to violent individuals, security companies that failed to protect patrons, landlords who ignored dangerous conditions, and in some cases, the perpetrators themselves. Victims may be entitled to compensation for medical expenses, lost wages, pain and suffering, psychological trauma, and in cases involving wrongful death, families may pursue damages for loss of companionship and financial support. Damages and Compensation in Assault Cases
Victims of violent assaults may be entitled to various types of compensation to help them recover from their physical, emotional, and financial losses. Understanding the different categories of damages can help victims and their families make informed decisions about pursuing legal action.
Economic Damages include tangible financial losses such as medical bills, hospital stays, rehabilitation costs, prescription medications, lost wages from time off work, and reduced earning capacity if the injuries result in long-term disability. These damages are typically easier to calculate as they involve specific dollar amounts and documented expenses.
Non-Economic Damages compensate for intangible losses that don't have a specific monetary value but significantly impact the victim's quality of life. These include pain and suffering, emotional distress, anxiety, depression, loss of enjoyment of life, and disfigurement or scarring. In New York, there is no cap on non-economic damages in most personal injury cases.
Future Losses account for ongoing medical treatment, therapy, rehabilitation, and lost future earnings if the victim cannot return to their previous level of work capacity. Expert testimony from medical professionals and economists often helps establish these projected costs.
The purpose of compensation in personal injury cases is not just to restore victims financially, but also to hold responsible parties accountable and deter similar incidents in the future.
