Despite the client's extensive smoking history that qualified him as high-risk, the doctor allegedly failed to educate him about or recommend low-dose CT screening for lung cancer, which medical experts assert was a clear deviation from established standards of care.
The United States Preventative Services Task Force had published clear guidelines in 2013 mandating that primary care physicians utilize low-dose computed tomography (LDCT) scans to screen certain high-risk patients for lung cancer. These guidelines were widely adopted by prominent organizations including the American Cancer Society, the Centers for Disease Control and Prevention, and the National Cancer Institute.
The client was diagnosed with Stage IIIB lung cancer in January 2019, by which time the cancer had already metastasized to multiple areas including his lymph nodes, mediastinum, ribs, and femur. He underwent extensive treatments including chemotherapy, immunotherapy, and radiation therapy, which caused severe side effects and diminished quality of life. Sadly, the late-stage diagnosis meant the treatments were ultimately unsuccessful, and he passed away in November 2020 under hospice care.
Prior to his illness, the client was described as an active, generous individual who maintained close relationships with family and friends. He was known in his community as someone always willing to help others with household projects and repairs. He shared a particularly close 23-year marriage with his wife, with whom he enjoyed various activities including car shows and daily neighborhood walks.
The economic impact of this case is substantial, with documented losses including Social Security disability and workers' compensation wages totaling over $241,000, plus an additional $194,000 in past and future loss of household services. Beyond the economic damages, the case involves significant pain and suffering endured by the client during his illness, as well as the profound loss of companionship experienced by his wife.
