Additionally, an oncology expert is prepared to testify that had the USPSTF guidelines been followed, the cancer would likely have been diagnosed at Stage I or II, when curative surgical treatments would have been available, potentially preventing the patient's death.
The case seeks compensation for multiple damages, including the patient's physical and emotional suffering, lost household services valued at over $296,000, past medical expenses of $23,401.12, and claims for loss of guidance and companionship for the surviving spouse and two daughters. The profound impact on the family includes witnessing their loved one's suffering through aggressive cachexia, terminal hypoxia, and progressive respiratory failure.
