The case centers around a 66-year-old woman who had been under the care of her primary care physician for 18 years, from 2002 to 2020. Throughout this period, the doctor was aware of the patient’s significant smoking history – approximately one pack per day since age 16. Despite this known risk factor, the physician failed to follow the U.S. Preventive Services Task Force (USPSTF) guidelines, which since December 2013 have recommended annual low-dose computed tomography (LDCT) screening for patients aged 55 to 80 with a 30 pack-year smoking history.

The consequences of this oversight proved fatal. In June 2020, the patient was diagnosed with Stage IV high-grade lung cancer with liver metastasis. Due to the advanced stage of the disease, chemotherapy was not a viable option, and she passed away just weeks later on July 9, 2020, following a period of significant pain and suffering.

An expert economist has calculated the loss of household services alone at $347,119, based on the 24 hours of weekly household services she provided and would have continued to provide for at least another decade. These services included cooking, cleaning, laundry, grocery shopping, and childcare for her grandchildren.

The settlement demand takes into account multiple factors: the clear deviation from the standard of care, the preventable nature of the tragedy, the patient’s pain and suffering during her final weeks, loss of consortium for her husband, loss of parental guidance for her adult children, and the quantifiable economic losses to the household.
