$1.7 Million Settlement Demanded in Medical Malpractice Case Involving Failed Knee Surgery

Following the failed ACL reconstruction, the client experienced rapid and atypical arthritic progression, ultimately requiring a total knee replacement at an unusually young age. Medical experts project that the client will require at least two additional knee replacements over their lifetime due to the limited lifespan of knee prosthetics.

The economic impact has been substantial. The client, previously employed as a Certified Nursing Assistant, has been unable to return to work since the surgery. Worker's compensation evaluations have assessed a 50% loss of use of the right lower extremity. Economic losses, including past and future lost wages, loss of household services, and future medical expenses, are calculated to exceed $1 million.

Beyond the financial implications, the impact on the client's quality of life has been profound. Previously an active individual who enjoyed motorcycling, hiking, baseball, and swimming, the client now faces severe limitations in physical activities and requires ongoing pain management. The chronic pain has also led to sleep deprivation and other quality-of-life issues.

The legal team has identified significant insurance coverage available through the involved medical providers, including at least $2.3 million in coverage for the primary surgeon and additional coverage for other defendants. A settlement demand of $1.7 million has been issued, reflecting the severity of the malpractice and its life-long impact on the client.
