Beginning in 2013, the patient began treatment with a pulmonologist for evaluation of a right apical lung nodule. Over the following years, multiple imaging studies showed concerning growth and changes in the nodule, with radiologists repeatedly recommending follow-up studies and biopsies. Despite these clear warning signs and explicit recommendations from specialists, the treating pulmonologist failed to take appropriate action, instead consistently minimizing the findings and delaying crucial diagnostic procedures.

The case reveals a particularly troubling pattern of deviation from standard medical practices. When a 2017 CT scan showed the nodule had grown to 7mm, the radiologist recommended a follow-up scan within three to six months. Instead, the pulmonologist characterized the findings as unchanged and delayed follow-up for a full year. This pattern continued through subsequent scans in 2018 and 2019, where despite increasing signs of malignancy and explicit recommendations for biopsy, appropriate action was repeatedly delayed.

The impact of these delays proved catastrophic. By the time the cancer was finally diagnosed in September 2020, it had progressed to Stage IV, dramatically reducing the patient's survival chances from an estimated 92% five-year survival rate to just 6%. The case was further complicated by subsequent surgical intervention that expert witnesses have characterized as contraindicated given the advanced stage of the disease.

Medical experts consulted in the case have identified multiple critical breakdowns in the standard of care, including failure to appropriately respond to cancer signs on imaging studies, failure to follow radiologists' recommendations for biopsy, failure to inform the patient of concerning findings, and failure to make timely oncology referrals. The thoracic surgeon involved in the case has also been criticized for performing surgery without reviewing crucial imaging studies and failing to properly stage the cancer.

The consequences for the patient have been profound. At just 62 years old, she now requires lifelong immunotherapy with debilitating side effects, including severe fatigue, nausea, and joint pain that has robbed her of her ability to enjoy former hobbies and regular interactions with her family, including twelve grandchildren and one great-grandchild. The economic impact is equally significant, with projected medical costs over five years estimated at $645,875.

The settlement proposal addresses both the substantial medical costs, including ongoing treatment expenses and Medicare liens, as well as compensation for the patient's profound pain, suffering, and loss of quality of life. These damages reflect not only the physical toll of unnecessary procedures and delayed treatment but also the emotional impact on both the patient and her family.
