The Porter Law Group recently secured a significant settlement in a medical malpractice case involving the tragic delayed diagnosis of breast cancer that ultimately claimed the life of a 53-year-old mother of five. In January 2021, the client discovered a concerning lump during a self-breast examination and promptly sought medical attention. A mammogram and ultrasound performed in February 2021 revealed a 2-3 cm mass in her right breast. Despite these findings, the radiologist classified the mass as "probably benign" and recommended a follow-up in six months rather than ordering an immediate biopsy.
When the client finally underwent follow-up imaging in August 2021, the mass had more than doubled in size to 5.5 cm. She was diagnosed with Stage IIIB triple-negative breast cancer that had spread to her lymph nodes. The delayed diagnosis forced her to endure extensive chemotherapy, a mastectomy, and radiation treatments that could have been avoided with timely intervention. Tragically, by April 2023, the cancer had metastasized to her lungs, liver, and bones, and she passed away in June 2023 at age 53.
Medical experts retained by the Porter Law Group testified that with proper interpretation of the initial imaging and immediate biopsy, the client would likely have been diagnosed at Stage IIA or earlier, when the cancer was still highly treatable with less invasive procedures. The experts concluded that the six-month delay allowed the cancer to progress from a treatable stage with an 81% 10-year survival rate to terminal metastatic disease.
The case highlighted several critical failures in the standard of care, including the radiologist's mischaracterization of the mass margins and inappropriate "probably benign" classification despite suspicious imaging findings. Expert breast radiologists testified that the standard of care required an immediate biopsy given the concerning mammogram and ultrasound results.
Beyond the devastating physical toll, the delayed diagnosis had a profound impact on the client's five children, ages 19-30, who watched their otherwise healthy and independent mother endure tremendous suffering in her final months. The settlement reflects both the significant economic damages, including lost wages and medical expenses, as well as the immeasurable loss of maternal guidance and support for her children.
