The Porter Law Group has successfully secured a settlement in a devastating medical malpractice case involving a misread chest X-ray that led to a 16-month delay in diagnosing lung cancer, dramatically altering the course of a 58-year-old patient's life. The case, which settled for $3.3 million, highlights the critical importance of accurate radiological interpretation and the devastating consequences of medical negligence.

In June 2018, the client visited her family doctor with complaints of pressure and crackling in her right lower lung, accompanied by a dry cough. Given her history of pleural effusion and previous smoking, a chest X-ray was ordered and performed immediately. The radiologist interpreted the X-ray as normal, reporting no signs of masses or abnormalities. This interpretation would prove to be a catastrophic oversight.
During the investigation, expert testimony from a board-certified radiologist revealed that the original X-ray clearly showed a 2-3 cm mass in the client's right lung that should have been identified. This missed diagnosis allowed the cancer to progress unchecked for 16 months, during which time it advanced from a highly treatable Stage I to Stage IV, with metastases to the brain and spine by the time it was finally discovered in October 2019.
The legal team assembled compelling evidence showing that had the cancer been properly diagnosed in June 2018, the client would have had a 100% five-year survival rate with appropriate treatment, according to SEER (Surveillance, Epidemiology, and End Results) data. A simple lobectomy would likely have resulted in a complete cure. Instead, the client has endured extensive treatments including brain surgery, 35 rounds of chemotherapy, multiple sessions of Gamma Knife radiation, and immunotherapy.
The case presented unique challenges during litigation, as the defendant radiologist maintained his position that the original X-ray showed no abnormalities, even when confronted with the specific area containing the mass during deposition. However, the strength of the expert testimony and the clear evidence of the missed diagnosis proved compelling.
The impact on the client's life has been profound and far-reaching. Beyond the physical toll of treatments, she has experienced seizures, respiratory failure, persistent pleural effusion, significant headaches, and numerous other devastating symptoms. The psychological burden has been equally severe, with the client facing depression, anxiety, and the constant fear of death. The effect on her family has been equally devastating, particularly on her husband, who has witnessed his wife's transformation from an active, healthy partner to someone requiring constant care and support.
The $3.3 million settlement reflects the severity of the negligence and its consequences, taking into account not only the client's physical and emotional suffering but also the impact on her family and the loss of household services, which an expert economist valued at $772,870. The settlement also accounts for substantial medical liens, including over $511,000 from the client's health insurance provider.
This case serves as a sobering reminder of the critical importance of thorough and accurate medical diagnoses, particularly in radiology. According to various studies, radiology errors occur in 3-5% of diagnoses, with failure to identify lung cancer being among the most serious missed diagnoses due to its aggressive nature and the importance of early detection.
