The case centered around a long-term doctor-patient relationship spanning more than 30 years, during which the medical provider failed to adequately educate the client about PSA screening and its significance in detecting prostate cancer. Despite the client presenting with concerning symptoms in July 2015, including unexplained fatigue and abnormal urination, and subsequently showing an elevated PSA level of 7.68 ng/mL in September 2015, the doctor failed to properly address these warning signs or initiate appropriate follow-up care.
The investigation revealed that the doctor's approach fell significantly short of established medical standards, including those set forth by the American Urologic Association. These guidelines, which were well-established in the medical community at the time, mandate that primary care physicians discuss with patients the risks and benefits of PSA testing to screen for prostate cancer.
The consequences of this delayed diagnosis were devastating. By the time the client's cancer was finally discovered in February 2021, it had progressed to Stage IV. The client was forced to undergo aggressive treatments, including a prostatectomy, 38 fractions of radiation therapy, and androgen deprivation therapy. These treatments resulted in severe side effects, including debilitating muscle and joint pain, significant muscle loss, and urinary incontinence that required extensive physical therapy.
Medical experts testified that with timely diagnosis, the client's cancer would likely have been detected at an early, surgically curable stage. Instead, the client now faces a significantly reduced life expectancy, with experts estimating a mere 30% chance of surviving five years from the time of diagnosis.
The impact on the client's quality of life has been profound. Once an active individual who regularly helped family members with home maintenance and enjoyed activities like golf, hunting, and motorcycle riding, he now struggles with basic daily activities and spends much of his time confined to bed. The emotional toll has been equally devastating, particularly given his close relationships with his three daughters and sister.
The settlement addresses not only the client's substantial past and future medical expenses but also acknowledges the significant pain, suffering, and loss of enjoyment of life resulting from the delayed diagnosis. The case underscores the critical importance of proper patient education and proactive medical care in managing potential cancer risks.
