The $3.3M Breast Cancer Misdiagnosis Settlement Case

Last Updated on Originally published October 14, 2024

The Porter Law Group recently secured a $3.3 million settlement in a breast cancer misdiagnosis medical malpractice case involving the misinterpretation of a mammogram, which led to a delayed diagnosis of breast cancer.

Our client, a woman in her late 50s, underwent a routine screening mammogram in September 2021. The radiologist interpreting the mammogram failed to identify a significant abnormality and reported the results as normal, recommending only routine annual follow-up.

Tragically, this oversight allowed an aggressive cancer to grow unchecked for over a year. By the time our client was correctly diagnosed in October 2022, the cancer had metastasized to her lymph nodes, liver, and bones. Despite aggressive treatment, she passed away in September 2023 at the age of 58.

Our legal team, supported by expert testimony, demonstrated that:

  1. The radiologist failed to identify and report a 9mm x 4mm x 9mm focal asymmetry in the right breast, which was visible on the September 2021 mammogram.
  2. The standard of care required recommending a targeted ultrasound given the presence of this abnormality.
  3. Had the cancer been diagnosed in late 2021, our client would likely have required only a simple lumpectomy or mastectomy, with an excellent prognosis for long-term survival.
  4. By the time of diagnosis, the cancer had progressed significantly, eliminating the possibility of curative treatment.

The impact of this breast cancer misdiagnosis medical error was profound. Our client endured nearly a year of aggressive cancer treatments, including chemotherapy and hormonal therapy, along with severe pain and numerous complications. Beyond the physical toll, she faced the emotional anguish of knowing her condition was terminal and that earlier detection could have saved her life.

The $3.3 million breast cancer misdiagnosis settlement reflects the severity of the negligence and its consequences. It accounts for our client’s pain and suffering, medical expenses, lost wages, and the devastating impact on her family. Her husband of nearly 30 years and their three adult daughters have lost a beloved wife and mother, and will miss her presence at countless future milestones.

This case is a stark reminder of the importance of thorough and accurate medical screenings. It highlights the need for:

  • Meticulous attention to detail in interpreting medical imaging
  • Prompt follow-up on any suspicious findings
  • Clear communication between healthcare providers and patients about screening results and recommendations

While no amount of money can truly compensate for the loss of a loved one, this settlement provides some measure of justice for our client’s family and helps ensure their financial security.

At the Porter Law Group, we remain committed to holding healthcare providers accountable for negligent practices and advocating for patient safety.
