About Defective Prescription Drug Injury Cases

Prescription drugs can be deemed defective due to the following:

  • Flaws in their composition or formulation,
  • Errors during the manufacturing process like incorrect dosage or contamination, or
  • Inaccurate information about risks and side effects.

When drug companies rush medications to market without adequate testing or fail to disclose known dangers, patients can suffer catastrophic harm. Doctors and pharmacists may also be liable if they negligently prescribe or dispense the wrong drug or dosage. If you were injured by painkiller or opioid overprescription in New York, click here

In product liability cases like ones involving defective drugs, manufacturers can be held strictly liable for injuries caused by their products, even in the absence of fault or negligence. Unlike negligence claims, which require proof that the manufacturer failed to exercise reasonable care, strict liability focuses solely on the condition of the product itself. The plaintiff must show that the product had a defect, that the defect caused their injury, and that it rendered the product unreasonably dangerous.

The defect can originate from various aspects of the product, such as its design, manufacturing process, or insufficient warnings. Importantly, strict liability claims are not limited to direct buyers of the product; bystanders and others who do not have a direct relationship with the product can also bring claims if they suffer injuries.

The rationale behind strict liability is that manufacturers are best positioned to ensure product safety and should bear the costs of injuries caused by defective products. By eliminating the need to prove negligence, strict liability facilitates injured plaintiffs' ability to recover damages and encourages manufacturers to prioritize product safety.

The Biggest Defective Drug Cases in the USA

The following are some of the most expensive settlements that pharmaceutical companies had to make due to their defective drugs:

  • GlaxoSmithKline settled for 3 Billion dollars in 2012 for their drugs Paxil, Wellbutrin, and Avandia. They misbranded the antidepressants Paxil and Wellbutrin, and offered incentives to doctors who recommended them for off-label use. They also failed to provide safety data for the diabetes drug Avandia, which had some heart safety concerns.
  • Takeda Pharmaceuticals settled 2.4 billion dollars in 2015 for the oral diabetes drug Actos because they failed to disclose the risks of bladder cancer involved when taking the drug.
  • Pfizer settled 2.3 billion dollars in 2009 for their anti-inflammatory drug Bextra, the antipsychotic drug Geodon, the antibiotic Zyvox, and the anti-epileptic drug Lyrica. These cases involved false claims, bypassing insurance programs, and offering incentives to doctors who prescribed the drugs for off-label use.

These are a few of the known biggest settlements involving faulty and dangerous drugs by pharmaceutical companies. Many people are harmed by taking medication that they believe would cure their ailments, and end up hurting them even more. If you are one of them, contact the personal injury lawyers at The Porter Law Group, and let us help you hold these companies responsible.

  • Medical bills
  • Lost income
  • Loss of earning capacity
