  • No caps on non-economic damages: Unlike many states that limit pain and suffering awards, New York allows juries to award whatever they believe is appropriate.
  • High cost of living: Medical care, lost wages, and future care needs all carry significantly higher price tags in New York, particularly in New York City.
  • Jury attitudes: New York juries, especially in New York City, have shown a consistent willingness to hold corporations and institutions accountable with substantial verdicts.

Medical Malpractice Settlements

Medical malpractice cases represent some of the most significant personal injury recoveries in New York. In 2024, the state processed 1,284 medical malpractice reports with total payouts of $595.42 million and an average payout of $464,000. By 2025, total payouts climbed to $729.58 million despite relatively stable claim numbers, suggesting individual case values rose substantially. Over 96 percent of all medical malpractice claims are resolved through settlement rather than trial.

Recent notable verdicts include:

  • $130 million awarded to a Suffolk County family whose daughter developed cerebral palsy due to oxygen deprivation during delivery

Most New York car accident settlements are calculated by multiplying economic damages (medical bills plus lost wages) by a factor based on injury severity:

  • Minor soft tissue injuries: 1.5 to 2 times economic damages
  • Moderate injuries (fractures, whiplash): 2 to 3 times economic damages
  • Severe injuries requiring surgery: 3 to 4 times economic damages
  • Catastrophic injuries (TBI, spinal cord): 4 to 5 times or higher

For example, a herniated disc case with $25,000 in medical bills and $8,000 in lost wages totals $33,000 in economic damages. Using a 3x multiplier for a moderate-to-severe injury, the typical settlement would be approximately $99,000.

  • Spinal cord injuries: $1,200,000 average; $500,000 to $20 million range
  • Traumatic brain injuries: $850,000 average; $100,000 to $10 million range
  • Internal organ injuries: $250,000 average
  • Broken bones and fractures: $125,000 average
  • Herniated and bulging discs: $75,000 average (higher when surgery is required)
  • Concussions: $35,000 average (higher with post-concussion syndrome)
  • Whiplash: $18,950 average
  • Soft tissue injuries: $15,000 average

Key factors that drive values within each category include the extent of medical treatment required, whether surgery was necessary, the duration of recovery, the presence of permanent impairment, and the impact on your ability to work and enjoy daily life.

Slip and Fall Cases

Premises liability settlements vary widely because no two accidents present identical facts. The severity of injury is the first critical factor, with traumatic brain injuries, spinal cord injuries, and complex fractures settling for substantially more than minor soft tissue injuries. The only available defense is proving the worker was the sole proximate cause of the accident, an extremely difficult standard to meet.
