$1.5 Million Settlement Reached in Mine Elevator Accident Case

On July 27, 2018, the client, who was 35 years old at the time, was one of 17 miners being transported down into the Empire State Mine in Gouverneur, New York when the elevator abruptly stopped while descending at high speed. The sudden stop caused the victim to suffer a severe right knee injury, including a complete knee dislocation that required multiple reconstructive surgeries.

The case centered on allegations that the elevator’s brake system failed due to a defective electrical connection in a control system circuit breaker. Evidence gathered during the investigation, including expert analysis and Mine Safety and Health Administration (MSHA) findings, indicated that negligence and manufacturing defects in the control system were the primary causes of the brake failure.

The client underwent several major surgical procedures to repair his knee, including posterolateral corner reconstruction, PCL reconstruction, and revision surgeries. Despite these interventions and extensive physical therapy, he was left with permanent limitations and ongoing instability in his right knee that requires him to wear a stabilizing brace indefinitely.  

Medical experts testified that the victim will likely require additional surgeries in the future, including a total knee replacement by age 50 followed by revision surgery approximately 17 years later. His orthopedic surgeon determined he has permanent restrictions that prevent him from returning to mining or any heavy manual labor.

Prior to the accident, the client had worked successfully as a mine laborer earning over $56,000 annually. Following his injury and lengthy recovery period, he attempted to return to lighter duty work but was unable to maintain employment due to his physical limitations. Vocational experts testified that his permanent restrictions, combined with his background in manual labor, left him with extremely limited employment options.

The settlement takes into account the client’s past and future lost wages, which economic experts calculated at over $1.8 million based on his inability to return to mining work. It also provides compensation for over $224,000 in anticipated future medical care costs and $261,000 for loss of household services.

The case highlighted important workplace safety issues regarding elevator maintenance and brake system inspections in mining operations. The Porter Law Group successfully demonstrated that proper inspection and maintenance protocols could have identified the defective component before it led to brake failure.
